Das schlimme ist, das „Microsoft“ sich solche finanziellen „Missgeschicke“ erlauben kann!
Andere wären jetzt konkurs oder ähnliches, überall will Microsoft mitmischen, auch
einen MP3 Player mit DRM Schutz hatten die auch mal im „Portfolio“.
Auch das „Projekt“ wurde vorzeitig beendet, weil es halt nicht angenommen wurde, dessen spezieller DRM Schutz.

Auch wenn man sein „Geld“ erstattet bekommt, ein bitterer Nachgeschmack bleibt.
Wenn die in den nächsten Jahren weiter so Geld „verbraten“ wird auch bei denen
irdendwann aus mit „lustig“ sein.

Davon mal ganz abgesehen, wüsste ich grade nicht, ob man nicht Microsoft wegen nicht erbrachter Vertragserfüllung verklagen könnte in diesem Fall??

Keine oder mangelhafte Vertragserfüllung

Wird der Vertrag nicht, nicht rechtzeitig oder nicht vollständig erfüllt, kann die andere Vertragspartei Gewährleistungsansprüche, Verzugsfolgen bis hin zum Rücktritt und möglicherweise auch Schadenersatzansprüche geltend machen.

Denn der Erwerb eines Ebooks (inkl. des DRM) ist nunmal keiner temporären Nutzung unterstellt! Ansonsten hätte man doch als Verkäufer einen Mietvertrag, anstatt eines Kaufvertrags anbieten müssen - oder seh ich das grad falsch !?

Wenn es doch erstattet wird, wäre es maximal eine Wandlung der Vertragsleistung. Die haben auch das sicher vertraglich abgesichert, könnte ich wetten. Gibt ja sicher noch mehr Leute, die auf diese Idee gekommen sind.

§ 5 Nutzungsvoraussetzungen von eBooks und Audio-Dateien

  1. XXXXX verschafft dem Kunden an eBooks und Audiodateien kein Eigentum. Der Kunde erwirbt ein einfaches, nicht übertragbares, vor vollständiger Zahlung der Lizenzgebühr widerrufliches Recht zur Nutzung des angebotenen Titels für den persönlichen Gebrauch.

PS. Man hat ohnehin kein „Eigentum“ an den „Ebooks“ sondern nur „Nutzungsrecht“.
Die „Käufer“ können sich das Geld für gekaufte Ebooks erstatten lassen, aber mehr ist
wohl nicht drin. ABER man sollte in Zukunft sich überlegen, ob man alle
„Microsoft“ Features haben möchte, wenn die solche Projekte einfach an die „Wand“
fahren. Wäre ich Kunde, würde ich versuchen alles Ausgaben wieder reinzuholen,
ist wahrscheinlich mit großen Aufwand verbunden (Belege suchen etc.).
Viele werden nicht reagieren, und haben somit Geld im „Sand“ gesetzt!
ABER bald läuft wieder die Geldmaschine für Microsoft, Windows 7 wird nicht
weiter unterstützt. Zumindest wissen, die man Gelder generiert…

Mit viel Sucherei kann man das widerlegen, denn Microsoft hat am 02.04.2019 als das „Closing“ eingeleitet wurde, zwar keine neue AGB herausgebracht, aber die Store-FAQs dahingehend neu veröffentlicht ! :wink:

Your pre-order will be cancelled, and you will not be charged for the purchase. We recommend you pre-order at another digital book store.

How do I get my refund?

Refund processing for eligible customers start rolling out automatically in early July 2019 to your original payment method. If your original payment method is no longer valid and on file with us, you will receive a credit back to your Microsoft account for use online in Microsoft Store.

What if I purchased a book with a gift card or credit, or no longer have the original payment method linked to my account?

Refunds will be credited back to your Microsoft account for use online in Microsoft Store.

What happens to books I’ve already purchased?

You can continue to read books you’ve purchased until July 2019 when they will no longer be available, and you will receive a full refund of the original purchase price.

What happens to books I’ve rented?

You can continue to read books you’ve rented through the duration of the rental period.

What happens to my free books?

You can continue to read free books you’ve downloaded until July 2019 when they will no longer be accessible.

What about my in-book notes?

Mark-ups and annotations made in books acquired from Microsoft Store will be available until early July 2019 when your books are removed from Microsoft Edge. If you have made mark-ups or annotations in any of your acquired books prior to April 2, 2019, you’ll receive an additional $25 credit to your Microsoft account at the same time refunds are processed.

When’s the last day I can read my books?

You’ll be able to read your books until early July 2019 when Microsoft processes the refunds.

What happens to my books in Microsoft Edge when I can no longer read them?

Your books will be removed from Microsoft Edge when Microsoft processes the refunds.
